Job description:

  • Responsible for the delivery of Contract Services and Strategy  from early projects phase to:
  • Provide the principal contract support and lead all contractual activities for the Project, including Client contracts, Partnership arrangements (jv, consortium) and major subcontractors/purchase orders
  • Protect and pursue TechnipFMC’s interests and contractual rights,
  • Maintain TechnipFMC’s liability exposure under strict control,
  • Track any risks and track/pursue opportunities in view of consolidating and increasing the project profit margin,
  • Submit, negotiate and settle change orders, claims and amendments,
  • Contract Manager may either assist two or more projects in parallel, or be fully assigned to a project.
  • Depending on assignment and profile, the function might include management of one or more Contract Specialists
Role and responsibilities:

Projects Contract Management:
  • The Contract Manager’s duties and responsibilities are to provide appropriate support and guidance to the Project Manager and leadership within the Project team in the management and administration of the contract, consistently with the relevant policies, standards and processes.
  • Participate in all project meetings (internal or with Client/Partners/Major Subcontractors and Vendors) when the agenda relates to the project status, cost and schedule issues in order to be aware of project activities, which may affect TechnipFMC in respect to contractual position and exposure to risks. The Contract Manager shall issue recommendations to the Project Manager for taking appropriate and timely actions to protect TechnipFMC interests.
  • Initiate, draft and/or review, as the case may be, all incoming and outgoing correspondence with Clients and Partners and, and whenever necessary in case of matters related to TechnipFMC’s liabilities, risks and contractual rights, the correspondence to and from subcontractors and vendors.
  • Provide to the procurement manager and the subcontract manager a flow-down of the contractual requirements to ensure TechnipFMC’s obligations set forth in the Prime Contract pertaining to subcontracting are fulfilled and furthermore to pursue a rational approach and an efficient control of the transfer of the contractual rights & obligations to all parties involved in the project execution under TechnipFMC’s responsibility.
  • Provide necessary support in the preparation of the Special Terms & Conditions for procurement and subcontracting and in the negotiation of critical terms with Vendors/Subcontractors hereafter.
  • Work closely with the project control to monitor schedule performance and cost trends in order to identify risks and opportunities for revenue enhancement, schedule relief and risks mitigation.
  • Prepare a consolidated analysis of the Contract Terms and Conditions to highlight the areas of risks and opportunities to be pursued. As the work proceeds, the Project Contract Manager shall assist the Project Manager in the management of these risks as they arise and in pursuing the opportunities in accordance with TechnipFMC’s targets.
  • Assist the Project Manager in analyzing and tackling project financial issues and follow up the client progress payment and billings to ensure compliance with contract terms and requirements in cooperation with the project controller.
  • Initiate and coordinate the preparation, negotiation and settlement of change orders and claims
  • Assist the subcontracting and procurement teams in the identification, negotiation and resolution of major change orders and claims of subcontractors and vendors.
  • Work with the other project team members to monitor and identify Client’s actions and/or inactions, which could result in contract changes and assist the Project Manager in their resolution with respect to additional compensation and time relief through change order management.
  • Monitor adherence to contract insurance provisions and coordinate any actions required in this regards with TechnipFMC insurance department; ensure that all information needed for insurance claims are collected in due time.
  • Support the Project Manager in the management of TechnipFMC contractual and commercial interests when working in JV or consortium with partners.
  • Liaise and obtain when required legal expertise from the Legal Team (corporate, compliance, litigation, general legal advice) and with other functions (treasury, tax, insurance, etc.) with the purpose of providing to the Project a comprehensive set of legal and contractual services.
Tendering Contract Management:
  • The Contract Manager supports and participates to the tendering process and carried out reviews of the Client-proposed drafts of Contract and their Exhibits as included in the Invitation To Tender (ITT) and as amended by the various bid bulletins.
  • The overall prime purpose of these reviews is to identify and assess the potential difficulties or roadblocks that may appear when administrating the Contract during the execution phase and propose alternates or clarifications to the Tender Manager / Legal Counsel in charge, or anticipate mitigations during project execution ( Change Orders, Schedule, reimbursable scope, rely-upon provisions, Client assigned items, nominated vendors, coordination with client and third parties interfaces, etc).
  • Liaise and obtain (if required) advise by the Legal Team (corporate, compliance, litigation, general legal advice), or by other functions (treasury, tax, insurance, etc.)
  • Support and/or coordinate the preparation of the Exhibits parts of the consortium/jv agreements (split of work, interface schedule etc.)
  • Participate in the negotiations with Client and potential partners

You are meant for this role if you have/are:

  • BAC + 5 or equivalent Master’s Degree, MS/MSc,
  • Proven minimum 7 / 10 years relevant experience in large EPC contracting within an international company is a must
  • Field experience either at site or yard is a plus
  • Effective written and verbal communication in English is a must
  • Strong negotiation skills and capacity to influence
  • Manage complexity, including large plant engineering and schedule
  • Strong communication and presentation skills
  • Open and direct dialogue with stakeholders
  • High level of integrity and ethics
